Contract transfer vs power of attorney

This is the most important point in the whole process, and the one people most often get wrong.

An agreement between you and the seller only

The unit stays in the original owner's name on the developer's system, and you hold a document that lets you act on their behalf. That leaves you exposed: if a dispute arises, if the original owner dies, or if their assets are frozen, the unit legally is still not yours.

Official contract transfer

The company itself changes the name

The developer's legal department reviews the paperwork, a new contract is issued in the buyer's name, and all unit records change on the company's system. The buyer becomes the contracting party, and the seller is fully released from the obligation.

One important note: transfer fees and conditions vary by developer, and some contracts require a minimum period or a minimum share paid before a transfer is allowed. That is the first thing we check in your contract, before your unit is listed at all.
